Mr. Xi signed the Hong Kong security law 2
Chinese state media confirmed that the National Security Protection Act in the Hong Kong Special Administrative Region was signed by Mr. Xi this afternoon.
In a statement posted at 6:00 p.m. today (5:00 p.m. Hanoi time), Xinhua said that the Hong Kong security law was passed by the Standing Committee of the Chinese National Assembly at the 20th session, to prohibit acts that threaten security.
Chinese President Xi Jinping.
The law consists of 6 chapters and 66 articles, regulating the responsibilities of organizations tasked with maintaining national security in Hong Kong, and defining 4 crimes of violating national security including secession and subversion.
The Standing Committee of the National Assembly of China also passed a decision to include this law in Appendix III of the Basic Law, acting as Hong Kong’s mini-constitution.
Chinese National Assembly Chairman Li Zhanshu described the Hong Kong security law as `reflecting the aspirations of people nationwide, including Hong Kong`.
According to the content of the law published by the Hong Kong government on the evening of June 30, China will have judicial authority over `very serious` national security crimes, and violators can be sentenced to life in prison.
The law stipulates three circumstances in which China will prosecute: cases involving complex foreign interference, `very serious` cases, and when national security faces a `serious threat`.
`Both the national security agency and Hong Kong can request to transfer the case to mainland China and the proceedings will be conducted by the Supreme People’s Procuracy. The trial will be heard by the Supreme Court
`Where violence is used, or the use of violence is threatened, the ringleaders or serious offenders shall be sentenced to life imprisonment or a minimum term of 10 years in prison,` according to the law.
The law also says certain national security cases can be tried behind closed doors, without Hong Kong judges present, if they involve state secrets, although the verdict and indictment will be made public.
Hong Kong Chief Executive Carrie Lam said the security law will take effect from 11pm on June 30.
In a previous video message to the United Nations Human Rights Council (UNHRC), Ms. Lam stated that the security law only `targets a very small group of law violators` to prevent, restrain and punish criminals.
`For the minority group that endangers national security, this law will become a sword hanging above them. However, for the vast majority of Hong Kong residents and foreigners in the special zone, the law plays the role of
The office’s statement added that the central government and Hong Kong will `work together` to ensure the law is implemented, helping `open a turning point to turn chaos into managed order.`
However, critics and some Western countries worry that the Hong Kong security law will limit democratic freedoms in the special zone, harming the `one country, two systems` policy.
